Pacific Hospitality Group Ventures, Inc., its subsidiaries, related companies, and other controlled affiliates (collectively, “PHG,” “we,” “us,” and “our”) created this policy to help you understand what information we collect, why we collect it, and how you can update and manage your information.


TYPES OF INFORMATION WE COLLECT


You may be asked to provide personal information anytime you interact with us, our affiliates, or our managed hotel and resort properties. The information we collect depends on how you use our services. The types of information we collect or that is collected on our behalf includes:

  • Contact information. Name, address, telephone number, email address, etc.
  • Demographic. Age, country, gender, primary language, etc.
  • Financial. Bank account number, payment card information, billing address, etc.
  • Minors. We do not knowingly collect personal information from any person under eighteen (18) years of age. Our website is directed to and intended for use only by those who are eighteen (18) years of age or over.
  • Reservation / Visit. The PHG-managed hotel(s) where you have stayed, date of arrival and departure, special accommodation requests, goods and services purchased, etc.
  • Website usage. IP address, login information, browser type, geolocation, operating system, etc.

COLLECTING YOUR INFORMATION


From you directly including when you:

  • Make a reservation, fill out a form, or make a purchase;
  • Communicate with us by email, telephone, in writing, or social media; or
  • Use any of our services, including when you stay with us or visit one of our properties.

When you access our website we may receive and store information generated by your activity and information automatically collected from your browser or mobile device.

Other sources such as:

  • Marketing service providers;
  • Individuals requesting services on your behalf;
  • Travel agencies or your company; or
  • Publicly available sources.

USING YOUR INFORMATION

  • We collect and use your information in order to provide you with the best experience possible and for the following contractual and legitimate purposes:
    • Customer support. Investigate and address your concerns; notify you of any changes to our services; respond to your inquiries; and to improve our customer support responses.
    • Improvement. Enhancing our websites; data analysis and audits; improving our services; conducting market research and quality assurance surveys; and developing new services.
    • Legal requirements. Investigating or addressing claims or disputes relating to your use of our services; as requested by regulators, government entities, and official inquiries; or as otherwise allowed by applicable law.
    • Marketing and promotions. With your consent, sending you emails and messages about news and new promotions, features, products and services, and content.
    • Reservations and purchases. Fulfilling your room reservation; supplying purchased goods and services; customizing our services to your preferences; and keeping proper records of those transactions.
    • Safety and security. Using closed-circuit television systems, electronic key cards, and other security systems to maintain the safety and security of you, our guests, visitors, and employees.

SHARING YOUR INFORMATION

We do not sell your name or other personal information to third parties. We may share your information with:

  • The PHG family of companies to help us provide our services or conduct data processing.
  • PHG service providers, including vendors, consultants, marketing partners, and other service providers or business partners, such as accountants and lawyers, cloud storage providers, data analytics providers, insurance and financing partners, marketing platform providers, payment processors, and research partners.
  • With your consent, we may share your information other than as described in this policy if we notify you and you consent to the sharing.
  • Legal reasons. We may share your information with third parties for legal reasons including:
    • Compliance with legal, regulatory, or administrative requirements of any government or law enforcement authority;
    • Compliance with a court order, search warrant, subpoena, or other legal process;

Your rights under the GDPR may include the right to:

  • Access information we retain about you;
  • Request correction of any incorrect or incomplete personal data we have about you;
  • Request that we erase your personal data;
  • Request that we restrict/suspend processing of your personal data;
  • Port your data to another service;
  • Complain to a supervisory authority; or
  • Withdraw consent.

Your California Privacy Rights. If you are a California resident, you have the right to request any of the following information from us regarding personal information collected about you:

  • The categories of personal information collected about you.
  • The categories of sources from which the personal information is collected.
  • The business or commercial purpose for collecting or selling personal information.
  • The categories of third parties with whom we share personal information, if any.
  • The specific personal information collected about you.
  • For personal information sold or disclosed to a third party for a business purpose, you have a right to know the categories of personal information about you that we sold and the categories of third parties to whom the personal information was sold; and the categories of personal information that we disclosed about you for a business purpose.

We will provide this information free of charge up to two (2) times in any twelve (12) month period within forty-five (45) days of receiving your verifiable request (including verification of your identity and your California residency), subject to delays and exclusions permitted by law. Specific personal information about you or your account that is categorized as sensitive or confidential may be redacted.

As a California resident, you have the following additional rights regarding your personal information:

  • Deletion. The right to request that we delete any personal information that we have collected about you. We will honor this request subject to the range of exclusions permitted by law. For example, we are not required to delete personal information if it is necessary to complete a transaction, or reasonably used for an ongoing business relationship, or if it is used internally in a lawful manner that is compatible with the context in which the consumer provided the information.
  • Right to Opt Out of the Sale or Sharing of Personal Information. The right to opt out of the sale of your personal information to third parties. You also have the right to opt out of the sharing of your personal information to third parties for cross-contextual behavioral advertising purposes. You also have the right to opt out of sharing the personal information of a child under the age of sixteen (16) without receiving opt-in consent. If you opt out, we will not sell or transfer your information to any third party except as otherwise authorized by law.
  • Right to Non-Discrimination. We will not discriminate against you if you choose to exercise any of these rights.
  • Correction. The right to request that we correct any inaccurate personal information that we maintain about you.
  • Right to Restrict Processing of Sensitive Information. The right to restrict the use and disclosure of your sensitive personal information.

California residents may exercise the rights described above by completing a Privacy Request Form, making such a request via an email to privacy@pacifichospitality.com or writing to us at Pacific Hospitality Group, Attention: Privacy Department, 2532 Dupont Drive, Irvine, CA 92612. We may require verification of your identity before further processing your request. In certain instances, we may be permitted by law to decline some or all of such requests.

  • We may occasionally update this policy. In the event we make significant changes, we will notify you of the changes on our website or through other means, such as email.
